If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. These Terms are governed by and understood in accordance with the laws of the State of Queensland, Australia. You unconditionally submit to the jurisdiction of the Courts of Queensland.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Where our goods come with guarantees that cannot be excluded under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.

Your use of the Website does not grant you a licence or act as a right of use of any of the trademarks or logos, whether registered or unregistered, that are displayed on the Website without the express written permission of the trademark owner. TERMS OF SALE

By placing an order for any Goods on the Website ("Order"), the Customer agrees to purchase the Goods subject to these Terms. Each Order the Customer places will be a separate and binding agreement between the Customer and ANETT with respect to the supply of the Goods in accordance with these Terms.

  • All Orders are subject to availability of the Goods and confirmation of the Order price.
  • Dispatch and delivery times are estimates only and are subject to delays resulting from postal delays or force majeure, for which ANETT is not responsible. Current estimates are set out in our Shipping Policy.
  • The Customer acknowledges that all Orders through the Website are for goods intended for personal and domestic use only, and not for commercial use.
  • ANETT reserves the right to accept or reject an Order for any reason at any time.
  • When placing an Order, the Customer undertakes that all details provided to ANETT are true and accurate, that the Customer is an authorised user of the credit or debit card used to place the Order, and that there are sufficient funds to cover the cost of the Goods. Cases of suspected fraud will be handed over to authorities.

RIGHT OF REFUSAL

ANETT reserves the right to refuse and/or terminate orders we deem to be objectionable. Orders that may be considered objectionable include, but are not limited to, suspicion of fraud, breach or non-compliance with store policy and these Terms, policy abuse, orders outside of our shipping zones, and abuse or harassment of staff members. We will make all reasonable efforts to rectify and clarify any issue before determining refusal or termination.

PRICE

Prices displayed in Australian Dollars (AUD) include Australian GST at 10%. Where prices are displayed in another currency, they are set for that market and do not include Australian GST.

For the United States, United Kingdom and Canada, import duties and taxes are included in the price shown and nothing further is payable on delivery. For all other countries outside Australia, prices exclude local taxes, VAT and customs or excise duties, which may be payable by the recipient on delivery. Any such charges are the responsibility of the recipient.

The price with respect to any Goods is specified on the Website ("Price") and is exclusive of any delivery fee.

ANETT reserves the right to change or alter the Prices of Goods on the Website without notice, unless the Customer has submitted an Order at a stipulated Price, in which case there will be no change to that Price. In paying or attempting to pay for the Goods, the Customer agrees that they have not engaged in any fraudulent conduct or contravened any law.

ANETT will issue the Customer with a tax invoice once payment in respect of the Order has been processed.

PAYMENT

ANETT accepts the payment methods shown at checkout. After you make payment for your order, we will email you an invoice confirming receipt of your order.

RETURNS AND EXCHANGES — CHANGE OF MIND

ANETT accepts returns and exchanges on the conditions set out in our Returns Policy. Please read it before returning any item.

If you change your mind, you may return an item for a store credit or an exchange within 7 days of delivery. Earrings and personalised or made-to-order jewellery are excluded, for hygiene and because they are made to order.

Items must be unworn (no scratches, no signs of wear, no alteration) and returned in their original packaging. If an item appears worn or is not returned in its original condition, a store credit or exchange will not be issued. Return postage is at the Customer's expense and original shipping charges are not refundable.

Change of mind does not entitle the Customer to a refund.

Faulty or damaged Goods are a separate matter and are covered by our 30-day manufacturing warranty below.

DAMAGED OR FAULTY GOODS — 30-DAY WARRANTY

All Goods are thoroughly inspected to ensure they are in the best condition prior to being sent to the Customer. All Goods come with guarantees that comply with Australian Consumer Law.

If the Customer discovers that a Good is faulty or damaged, the Customer must notify ANETT within 30 days of delivery. This 30-day warranty period is separate from, and longer than, the 7-day change-of-mind window above.

Notify us either by returning the goods with the return slip and an explanation, or via email at info@anett.com.au with a description of the product, the fault, and the Customer's preference for a refund, replacement, exchange or repair.

If ANETT inspects the Good and confirms that there is a fault, the Customer will be entitled to a full refund, a replacement (if available), an exchange or a repair (where possible). This applies to all Goods, including earrings — the hygiene exclusion above applies only to change-of-mind returns.

Customers are liable for any delivery costs if the Good is found not to be faulty.

DELIVERY

Any period or date for delivery of Goods stated by ANETT is an estimate only and is not a contractual commitment. Deliveries are subject to delays resulting from postal delays or force majeure, for which ANETT is not responsible. Orders are dispatched within 1–2 business days from the date of the Order. If an item is out of stock, we will notify you by email.

Australia: All deliveries of Goods purchased by the Customer will be made by Australia Post. ANETT reserves the right to refuse Authority to Leave where the delivery address is unoccupied, due to liability in circumstances where a parcel is lost. In that case a collection card will be left in the Customer's post box with details of how and where to collect the goods. At that point the goods will be deemed delivered.

International delivery: International deliveries will be made by Australia Post. Current delivery estimates for each destination are set out in our Shipping Policy.

LOST PACKAGES

We do not accept responsibility for lost orders as a result of a third party's negligence or otherwise, so far as we can provide proof of shipment. If your order is missing, please contact us immediately.

LINKING TO THIS WEBSITE

The Website may provide links to websites and access to content from third parties, including users and affiliates of ANETT. The Customer agrees that ANETT is not responsible for the availability of, or content provided on, third party websites.

The Customer should refer to the policies posted by other websites regarding privacy and other topics before using them. To the fullest extent permitted by law, ANETT, its officers, agents and employees will not be held liable for any remedy at law or in equity for any loss or damage incurred from dealing with any third party.

MISCELLANEOUS

We rely upon your continued observance of these Terms. If we suffer loss or damage, or incur any costs, associated with any breach by you of these Terms or any associated legal obligation, you agree to indemnify us for those losses, damages and costs, except to the extent they were caused by our own act or omission.

LIMITATION OF LIABILITY

Subject to the Australian Consumer Law clause above, ANETT will not be liable for any direct, indirect, incidental, special or consequential damages resulting from use of or inability to use the Website, from the cost of procurement of substitute products, from any products purchased or obtained, from messages received or transactions entered into through the Website, or from unauthorised access to or alteration of your transmissions or data or of any information contained on this Website — including but not limited to damages for loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages.
